Acceptable Use Policy

1. Purpose

WindowsVPS resells virtual and dedicated servers running on shared, third-party infrastructure (currently Hetzner Online GmbH and OVHcloud/Kimsufi). Abuse originating from any single customer's server can affect the network reputation and availability of infrastructure shared by all our customers, and can result in our upstream providers suspending our master account entirely. This Acceptable Use Policy ("AUP") exists to prevent that, and is incorporated by reference into our Terms of Service.

2. Prohibited Activities

You may not use the Service to:

Launch or participate in denial-of-service (DoS/DDoS) attacks against any target.
Run an open mail relay, send unsolicited bulk email (spam), or falsify sender/header information in email.
Mine cryptocurrency, or run cryptocurrency-mining software of any kind on our infrastructure.
Host or distribute malware, ransomware, phishing pages, or command-and-control infrastructure.
Scan, probe, or attempt to gain unauthorized access to networks or systems you do not own or have explicit permission to test.
Host illegal content under the laws applicable to the relevant data center jurisdiction, including but not limited to child sexual abuse material, content facilitating human trafficking, or content that infringes third-party intellectual property rights.
Host extremist, obscene, or content that offends common standards of decency, or content that is defamatory, harassing, or unlawfully discriminatory.
Send false or misleading information to circumvent identity or fraud checks.
Violate export control or sanctions laws applicable to you or to us.
Resell or sublicense the Service to third parties without our prior written consent.
Take any action that degrades the performance, security, or availability of our infrastructure or that of our upstream providers for other customers.

3. Enforcement

Severe violations (DDoS activity, spam/open relay, cryptocurrency mining, malware hosting, or illegal content) may result in immediate suspension or termination without prior notice, to limit harm to shared infrastructure and other customers.
Lesser violations may result in a notice and a reasonable opportunity to remediate before suspension.
We may cooperate with law enforcement and our upstream infrastructure providers in investigating abuse reports, and may disclose account information as legally required.
Termination for an AUP violation does not entitle you to a refund of fees already paid.

4. Reporting Abuse

If you believe a WindowsVPS-hosted server is being used to violate this policy, please report it to [email protected] with as much detail as possible (source IPs, timestamps, logs).

5. Relationship to Upstream Providers' Policies

Where your server runs on Hetzner or OVHcloud/Kimsufi infrastructure, their own acceptable-use policies apply to your use in addition to this AUP. A violation of their policies that leads them to act against the underlying server (e.g. a null-route or lock) is outside our control, and we will pass along any required remediation steps to you.
